Pressured to Sell

A clawback or clawback provision is a special contractual clause typically included in employment contracts by financial firms, by which money already paid must be paid back under certain conditions. The term also is in use in bankruptcy matters where insiders may have raided assets prior to a filing, and in Medicaid, when a state recovers costs of long-term care or covered medical expenses from the estates of deceased Medicaid patients. The aim of the clause is to secure an option for an employer or trustee to limit bonuses, compensation or other remuneration in case of catastrophic shifts in business, bankruptcy, and national crisis as the financial crisis of 2007–2010, and for states to recoup the cost of administering Medicaid services. The term clawback is recently in the financial news because of Wells Fargo’s retail banking employees were pressured into cross selling products to bank customers without their knowledge. I know a little something about cross selling having done so in three industries in which I previously worked, all above board and with the customer’s knowledge I may add, all for employee enhancement in the eyes of management or monetary bonuses. I can understand just how such a scheme can be accomplished, in one of the industries I was associated with involved high net-worth individuals, so it was thought to be quite easy to nickel and dime their accounts without them becoming aware, of course I never did any such thing. But the ‘how to’ was often talked about in the industry, but there was always the fear of anyone worth a few bucks would most likely have an assistant with a keen eye, a detailed oriented   assistant that would be watching every penny of their boss’s purchases, so, those nickels and dimes was not worth, in my view, becoming unemployed and branded a cheat. However, in the public case of Wells Fargo, the clawback involved tens of millions of dollars, claw backing one or two million just may be worth the effort, just kidding, or on the other hand, being referred to as a millionaire cheat, ‘thinking out loud’ may not be so bad after all…at least I will be able eat and live well but not being allowed to enter into the good gracious of my fellow human beings here on earth…may not, again, thinking out loud, be worth it after all it having been said and done…

The Cosby Show…

The show focuses on the Huxtable family, an upper middle-class African-American family, living in an brownstone in Brooklyn Heights, New York, at 10 Stigwood Avenue. The patriarch is Cliff Huxtable, an obstetrician, son of a prominent jazz trombonist. The matriarch is his wife, attorney Clair Huxtable.

They have five children, four daughters and one son: Sondra, Denise, Theo, Vanessa and Rudy. Despite its comedic tone, the show sometimes involves serious subjects, like Theo’s experiences dealing with dyslexia, inspired by Cosby’s dyslexic son, Ennis. The Cosby Show was a learning, moral, and a how to center for good upstanding family life, that was portrayed as a role model to be envied and followed. The program was fixated on education, the family was better off than most hyphenated American families living in Brooklyn, New York. TV-Guide ranked it 28 among the top 50 greatest shows, it even sold well in reruns. Well, nothing is good for ever, or even last as long as good will allow it to last. As soon as rumors began stirring about Bill Cosby’s legal affairs, the show began to be cancelled everywhere almost overnight. So, what happed to all that good moral upstanding message the show was supposed to be projecting, it was still there, it was its star that became tarnished, Americans never could separate the real-life person from their fictionalized character. It’s as if a favorable story line in a television show reflects a person in real life, meaning, the devil in a play is a devil in real life, nothing could be farther from the truth, a good television show is a good television show nothing more, nothing less. So, why can’t the lessons taught in The Cosby Show continue to be taught with some sort of disclaimer like, ‘Mr. Cosby is a son of a bitch and has no bearing on the character in the following photoplay’…but only after a conviction for his affairs of course…so until then, enjoy The Cosby Show on a network with balls enough to begin to start showing it again…   

 

Ham Handed

Tom Delay, a congressional majority leader in the United States, was indicted on ethics violations. His colleagues came to his defense by invoking the “ham sandwich” defense. This defense became well known when Delay defender Senator Mike Rodgers confused the public by misusing the phrase when he said “… any attorney knows you can get an indictment with a ham sandwich.” Obviously he meant “against a ham sandwich.” Source, Mitch Monmouth, 07/31/05

 

The confirmation of Neil Gorsuch as a Supreme Court justice will in my view forever stand in relationship to congressional partisanship of a ham sandwich in the U.S. senate. The Republican party possessed a 52-48 senate majority, not enough for a confirmation of a Supreme Court justice, which requires at least a 60-majority vote count, so, the Republicans invoked a rule change, the so called, ‘nuclear option’, requiring a simple majority for confirmation, here’s where the phrase ham sandwich comes in, meaning that the majority party in the senate can from now on confirm a ham sandwich, if they so wish, a Supreme Court nominee. It must be noted that three Democratic senators voted for Gorsuch’s confirmation, a Republican senator missed the vote due to illness, just for you vote counters. Democrats claimed that Gorsuch was so extreme and outside of judicial mainstream, he could never be considered a true representative of the nine-to-five working American, only of the corporate business board room types, in short big business interests. On April 13th Gorsuch will be invited to attend the private justices conference to consider new cases for the new fall term, I envision him presenting himself with the statement, ‘don’t hate me because I got here on a pure partisan vote like a ham sandwich’ with just a little mayo and pickle on the side…

 

 

 

 

Analytically Syria

The number of refugees who have fled Syria for neighbouring countries has topped five million people for the first time since the civil war began six years ago, according to the UN’s refugee agency.

Half of Syria’s 22 million population has been uprooted by a conflict that has now lasted longer than the second world war, the figures released by the UNHCR show, with 6.3 million people who are still inside the country’s borders forced from their homes.

The figure of five million refugees “fails to account for the 1.2 million people seeking safety in Europe”, the International Rescue Committee, an aid organisation, noted. Nearly 270,000 of these applied for asylum in Germany last year. Source, Matthew Weaver, theguardian…

 

I am moved that the President of the United States was deeply moved by just a small number of Syrian people, that were attacked and killed by chemical weapons, when the killings have been going on, on a massive scale for years, some with pictures many without, and like a lot of scenes of harrow that can be viewed repeatedly it’s those that will always have a much longer, lasting influence on the heart strings and move one to action no matter if belatedly. When the cry went out from those seeking refuge from the carnages, the request was flatly denied, reasoning own safety is not to be placed at risk from those in urgent need of sheltering from harm. When it has been said that most Syrians would rather remain in the region though very dangerous, fearing ill treatment in other countries, that have been well documented even in the land of immigrants. The international community has turned a blind eye and deaf ear to all the suffering until chemical use flashed one harrow able death over another when the end is the same and just as bad and life ending. Everyone seem to agree that the repeated use of chemical weapons on people must not continue, beyond that, the world becomes mum once again…until the recent scenes are displayed again in reruns…

Babe, Broad, Dame, Doll, Gal, Squaw, and Finally, Lady…

Members of Parliament debated a ban on mandatory workplace high heels, in response to a petition started by a receptionist who was sent home without pay for wearing flat shoes. The debate was non-binding, but the government promised to act against heel-height rules, makeup guidelines and other corporate codes that apply to women but not to men. Source, BT Toronto…

 

I confess that I never gave much thought to what women wore in the workplace until stories like the above started breaking out all over the place, I wager few women did either, thinking that is just the way things are for women, after all there are enforced dress codes everywhere, either strictly or passively imposed. A suit and tie are required dress of men who appear on the floor of the New York Stock Exchange, and except for casual Fridays’ a certain propriety of dress is expected of all during the rest of the work week in most places of employment, no jeans or flip flops. But when it comes to women, it seems to be more sexist then proper, after all short men have been wearing heels in the work place for years without any official comment from anyone. Attractive women have always been conveniently or connivingly placed at the reception desk for years, while the other less so can be found laboring in the back offices out of sight. In broadcast news, the female anchors that are, the field reporters that are, fill in the space. Let’s face it, we live in a sexist societal world, but only a few women are fighting back either publicly or secretly. More females are encouraged to dye their hair to look younger than males though males are fast getting into the fad too. At government to government meetings the men can be heard discussing weighty issues of the day while the women are passing tea and cookies while conversing in the raising of children, nannies and schools. I watch a lot of entertainment talk shows on television that always feature a good-looking actress plugging a movie or play, it’s the walk-on that always catches my eye, the high heels, almost never flats, unless the guest is Rachel Maddow, who more than likely will be wearing tennis shoes, it’s how they appear walking as they take to the couch as if they wear heels all the time in their private lives, believe me they don’t, comfort is not built into high heels, sexism is…

If I was from outer space, waring with a united earth, to win that war, first I would try and divide the earth into separate sections, conquering each section covertly one by one without anyone of them realizing it. A united Europe (Union) and United Nations would be my prime targets. Having presented the above who’s to say that there is some hidden sinister movement afoot here on earth already practicing, ‘divide and conquer’. First started in North America, with a kind of a ‘America First’ movement, hoping that they will want to wall them self-off from part of their continent, then feed political self-separatism in part of the United Kingdom in a kinda Brexit like movement, moving on to France, convincing them to vote the same, separatism, on the march, then Germany, then on to The Netherlands, you must be able to see the full picture by now. Spark suspicion of outsiders in each one, insuring a kinda closed society, killing any enfranchising of its people, once done, grab them by the balls, the rest of them will follow…conquering without firing a shot, winning long before they knew what had just been heaped upon them, a war well fought and won…a new world order now in place…

BELGRADE — Despite a warm round of congratulations from EU leaders to Aleksandar Vučić on his presidential victory in Serbia this week, Brussels should be worried about the future of this candidate for membership in the bloc.

It was the promise of prospective EU accession that propelled Vučić’s party into power in 2012. Back then, nearly 70 percent of voters wanted to join the European Union.

 

 

Fast forward to 2017 and none of the presidential candidates included EU membership in their campaign pledges. That’s because polls show support for integration has fallen to 43 percent, with 35 percent of my fellow Serbs saying they are against a future in the bloc. Source, POLITICO…

 

A Binding and Thickening Agent?

Accreditation occurs when a new ambassador presents “letters of credence”, or diplomatic credentials, to the host country’s head of state. Letters of credence, which are signed by the ambassador’s own head of state, confirm that the ambassador is authorised to represent his or her country, and ask that the host country respect this fact. As far as I can tell the only credentials the Presidents thirty-six-year old son-in-law, Jared Kushner, will have in his possession as he travels the globe is the assurance of having the Presidents ear, otherwise, no other professional edification will be needed for his meetings in Iraq and with other top U.S. generals around the world; is that enough? Enough to be able to process all he has and will learn, transferable into a sound foreign policy, based on and coupled with past experiences of which there are none to mention. Kushner has been given a plate full of responsibilities, including the stellar at the top, a Middle East peace affair, that have eluded the best diplomatic minds the world has ever known, and with him it is only one of many world and domestic puzzles for him to try to solve. With what he has learned during his travels, reporting back to his boss, a political novice, is like having two ten-year old’s in a professional kitchen traying to figure out how to bake a cake but must first be able to figure out how light an oven. The enemy around the world at this time is the Islamic State, there is no known long term creditable interaction of either the President or Kushner with any Muslims, an understanding that would have to play a key role in combating the movement in any meaningful structure, ever hear of the phrase, first ‘know they enemy’, born in Livingston, New Jersey, graduated cum laude from Harvard College with a BA (Bachler Arts) seems on the surface like very little preparation to tackle the worlds hot spots fresh out of the gate with any romantic or passionate liaison of affairs both foreign and domestic…
